PLANNING

Prenuptial + Postnuptial Agreements

A marital agreement works when it is clear, informed and designed around the assets and risks the parties actually have—not a generic form downloaded two weeks before the wedding.

The approach

Prenuptial and postnuptial agreements can address property rights, business interests, inheritance expectations and other financial consequences of marriage. Drafting and enforceability both depend on process as well as language.

Business protection

Ownership interests, appreciation, distributions and compensation can be treated differently. The agreement should match the actual business structure.

Disclosure + process

Financial disclosure, timing, independent counsel and voluntariness matter. Rushed execution creates unnecessary enforceability risk.

Future-proofing

Good drafting anticipates changes in residence, career, children, wealth and tax law without pretending every future fact can be predicted.

What can an Illinois premarital agreement cover?

A premarital agreement can address property rights, management and disposition of property, maintenance, estate-planning provisions, life-insurance benefits and other permitted subjects. It must be written and signed by both parties; the statute does not require consideration. Signing is not, by itself, a guarantee that every term is enforceable.

A child’s right to support cannot be adversely affected by a premarital agreement. Do not assume a financial agreement can predetermine every later parenting or child-support issue.

Enforceability requires attention to the actual statutory test. Section 7 identifies involuntary execution as one ground and separately addresses unconscionability at execution together with specified disclosure, waiver and knowledge conditions. Incomplete disclosure should not be described as automatically defeating every agreement regardless of the remaining facts. The statute also provides a specified undue-hardship exception concerning maintenance.

What should you gather before discussing an agreement?

Prepare an accurate asset-and-debt inventory, income information, business and trust documents where relevant, and a clear description of the goals. Discuss both expected events and less convenient possibilities: career changes, children, disability, a business sale or a long marriage. Leave time for advice, disclosure and revisions instead of making the signing date the entire plan.

An amendment or revocation of an existing premarital agreement after marriage must be written and signed by both parties under Section 6, and does not require consideration. A new agreement first made during marriage calls for its own enforceability analysis; it should not simply be assumed to follow every rule for a premarital agreement.

QUICK ANSWERS

Questions that come up early.

When should we start a prenup?

Earlier is better. Time permits full disclosure, thoughtful negotiation and independent counsel without unnecessary pressure near the wedding date.

Can a prenup address maintenance?

Illinois agreements can address maintenance, subject to statutory enforceability rules and circumstances at enforcement.

What is different about a postnup?

A new agreement made during marriage needs its own enforceability analysis. Amending an existing prenup is different: Section 6 permits a written amendment signed by both parties without consideration. Discuss the proposed agreement, disclosure and circumstances before assuming the premarital rules apply unchanged.
